1.1 For the purposes of this Policy, and any supplementary instruments, addenda, or codicils arising therefrom or hereunder, the following definitions shall apply unless the context otherwise requires, in which case the definitions shall still apply but with a more flexible interpretive posture, as determined at the sole and absolute discretion of the Strathmere Invitational Data Governance and Compliance Division (hereinafter "The Division"), a body whose authority is considerable and whose patience for ambiguity is not.
1.2 "Personal Data" shall mean any information relating to an identified or identifiable natural person (hereinafter "Data Subject"), including but not limited to: names, email addresses, prediction submissions, device identifiers, browser session data, time-of-access metadata, the general emotional tenor of your interaction with this website, and any inferences that may be reasonably or unreasonably drawn therefrom by The Division in the exercise of its legitimate functions.
1.3 "Processing" shall mean any operation or set of operations performed upon Personal Data, whether or not by automated means, including but not limited to: collection, recording, organization, structuring, storage, adaptation, alteration, retrieval, consultation, use, disclosure by transmission, dissemination, alignment, combination, restriction, erasure, destruction, and the quiet contemplation of data in a darkened room during the off-season.
1.4 "Controller" shall mean The Strathmere Invitational, a private golf tournament of exceptional distinction, which determines the purposes and means of the processing of Personal Data. The Controller is committed to responsible stewardship of all data entrusted to its care, which is to say: your name, your email address, and who you think is going to finish last.
1.5 "Legitimate Interest" shall mean any interest The Division has designated as legitimate following an internal balancing exercise in which the interests of the Controller are weighed against the interests of the Data Subject, and the Controller's interests prevail, as is customary in such exercises.
1.6 "Third Party" shall mean any natural or legal person other than the Data Subject, the Controller, or processors operating under the Controller's direct authority. Third parties include but are not limited to advertising networks, data brokers, shadowy consortiums, your caddy, and anyone else who is not us.
2.1 This Policy applies to all Personal Data collected, processed, or otherwise encountered by the Controller in connection with the operation of strathmereinv.org (hereinafter "the Site"), the Fan Picks submission portal, the Marquee Matchups Pick'em feature, and any other digital or analog properties of the Strathmere Invitational ecosystem as may exist now or arise in the future through mechanisms presently unknown to science.
2.2 This Policy does not apply to data collected by third-party services that may be linked to or from the Site. The Controller expressly disclaims responsibility for the privacy practices of third parties, their data governance frameworks, their cookie policies, and their general comportment.
2.3 By accessing the Site, submitting your picks, or simply existing in the digital vicinity of strathmereinv.org, you acknowledge that you have read, understood, and agreed to the terms of this Policy. If you have not read this Policy, we appreciate your confidence. If you have read this far, we appreciate your stamina.
3.1 The Controller collects Personal Data through the following mechanisms:
3.1(a) Voluntary Submission — Data you provide directly, including your name, email address, your top 5 predicted finishers, your bottom 5 predicted finishers, and your designated winner pick. The Controller notes, without judgment, the confidence this submission implies.
3.1(b) Automated Collection — Standard server logs, session data, and analytics collected in the ordinary course of operating a website in the modern era. This should not be interpreted as surveillance, though The Division acknowledges the distinction is, philosophically speaking, a matter of some ongoing debate.
3.1(c) Derived Data — Inferences made on the basis of data you have provided, including your assessment of the competitive field, your confidence level relative to peers, and your apparent belief that certain competitors are due for a very difficult weekend at Field of Dreams.
3.2 The Controller does not collect financial information, government-issued identification, biometric data, precise location data, or your honest opinion of the Commissioner's handicap.
4.1 The Controller processes Personal Data for the following purposes, each of which the Controller hereby designates as a legitimate interest under applicable frameworks:
4.1(a) The administration of the Fan Picks competition, including tabulation of scores, computation of aggregate statistics, and the identification of the individual who most accurately predicted the outcome of the tournament.
4.1(b) The delivery of occasional communications regarding the Strathmere Invitational, including pre-tournament updates, results announcements, and any other correspondence The Division deems of sufficient merit to transmit.
4.1(c) The improvement of the Site through analysis of aggregated and anonymized usage data, conducted in a manner designed to enhance the experience of future visitors without meaningfully affecting your own.
4.2 The Controller does not sell, rent, license, or transfer Personal Data to third parties for commercial purposes. The Controller does not use Personal Data for targeted advertising. The Controller does not share your picks with the players you picked, though it acknowledges this would be extremely funny.
5.1 Personal Data is retained for the period necessary to fulfill the purposes outlined in Article IV, and thereafter for a reasonable additional period determined by the Controller having regard to the historical and archival significance of tournament data, the legitimate interests of future researchers, and a general institutional reluctance to delete anything that feels like it might matter someday.
5.2 The Controller maintains the following retention schedule, subject to revision at the Controller's sole discretion: prediction data is retained for the duration of the applicable tournament year plus one additional calendar year for scoring verification purposes; email addresses are retained indefinitely unless deletion is requested pursuant to Article VII; aggregate statistical data derived from submissions is retained permanently as part of the tournament's historical record; server log data is retained for a period not exceeding ninety days, unless the Controller determines a longer retention period is warranted by circumstances it declines to enumerate in advance.
5.3 At the conclusion of each applicable retention period, the Controller shall take reasonable steps to ensure that the relevant Personal Data is deleted, anonymized, or otherwise rendered incapable of identifying the Data Subject. The Controller acknowledges that "reasonable steps" is a phrase that permits a range of interpretations and has deliberately declined to define it further, on the grounds that over-specification creates obligations the Controller does not wish to assume.
5.4 The existence of backup systems, disaster recovery infrastructure, and archival storage means that deletion, once initiated, may not be instantaneous or complete across all systems simultaneously. The Controller wishes to be transparent about this limitation without committing to a specific remediation timeframe, which it declines to do.
5.5 Deletion requests submitted pursuant to Article VII will be actioned on a first-received basis unless the Controller determines that prioritization is warranted, in which case prioritization will occur at the Controller's discretion.
6.1 The Controller employs appropriate technical and organizational measures to protect Personal Data against unauthorized access, alteration, disclosure, or destruction. These measures are proportionate to the sensitivity of the data involved, the cost of their implementation, and the Controller's assessment of the prevailing threat environment, which it reviews periodically and finds, on balance, manageable.
6.2 Technical measures currently in place include, without limitation: encrypted data transmission via industry-standard protocols; access controls limiting Personal Data visibility to authorized personnel on a need-to-know basis; authentication requirements for administrative and database systems; and server-level security configurations appropriate to a tournament of this nature and scale.
6.3 Organizational measures currently in place include, without limitation: internal data handling guidelines communicated to relevant personnel; a defined chain of responsibility for data governance decisions terminating at the level of the Controller; and the existence and active operation of The Division, whose authority and mandate are described in Article I and whose commitment to the protection of Personal Data the Controller characterizes, without reservation, as genuine.
6.4 In the event of a security incident affecting Personal Data, the Controller will take prompt remedial action and will notify affected Data Subjects in accordance with applicable legal requirements, or earlier if the Controller determines that earlier notification is in the Data Subjects' interest. The Controller notes sincerely that it hopes this clause will never be relevant.
6.5 No security system is perfectly impenetrable. No representation to the contrary is made or implied by this Policy or any other communication from the Controller. The fact that you are reading this sentence suggests the Site remains operational, which The Division continues to regard as a favorable indicator, all things considered.
7.1 Subject to applicable law, the Data Subject may have the following rights with respect to their Personal Data: the right to access a copy of the data held about them; the right to request correction of inaccurate or incomplete data; the right to request deletion; the right to object to processing conducted on the basis of the Controller's legitimate interests; the right to request restriction of processing while a complaint or dispute is pending; and the right to data portability where processing is carried out by automated means. The exercise of these rights will not affect the Data Subject's standing in the Fan Picks competition, their eligibility for the prognosticator scoreboard, or anyone's opinion of them.
7.2 To exercise any of the rights described in section 7.1, the Data Subject should submit a written request to the Controller via the contact details set out in Article IX. The Controller does not require the Data Subject to explain their reasons for the request, though it acknowledges being curious.
7.3 The Controller will respond to rights requests within a reasonable timeframe, which it defines operationally as one calendar month from receipt, unless the volume or complexity of pending requests warrants an extension, in which case the Controller will notify the Data Subject and provide an explanation.
7.4 In certain circumstances, applicable law may permit the Controller to decline a rights request. In any such case, the Controller will communicate its decision and the basis for it to the extent permissible.
7.5 The Data Subject retains the right to lodge a complaint with the relevant data protection supervisory authority if they believe the Controller has not handled their Personal Data in accordance with applicable law. The Controller encourages the Data Subject to contact it directly before pursuing any external complaint process, on the grounds that most things can be resolved with a well-worded email.
8.1 The Site uses cookies and similar tracking technologies. A cookie is a small text file placed on the Data Subject's device by a website for purposes including session management, preference storage, and analytics. The Controller wishes to note, as a matter of record, that it did not invent cookies and accepts no responsibility for the name, which it acknowledges creates unnecessary confusion in documentation of this kind.
8.2 The Site employs the following categories of cookies:
8.2(a) Strictly Necessary Cookies — Required for the fundamental operation of the Site, including maintaining the Data Subject's session and remembering whether they have already submitted their picks. These cookies cannot be disabled without materially impairing Site functionality. The Controller does not request consent for these cookies on the grounds that it cannot, in good conscience, offer the alternative.
8.2(b) Analytics Cookies — Used to collect information about how visitors interact with the Site, including which pages are accessed, how long visitors remain, and by what means they arrived. This data is aggregated and anonymized. No individual Data Subject is identifiable from analytics data.
8.2(c) Functionality Cookies — Used to retain the Data Subject's preferences and settings between sessions, ensuring a consistent experience across visits. These cookies store no Personal Data beyond what is strictly necessary for this purpose.
8.3 Cookies placed by the Site are either session cookies, which expire when the Data Subject closes their browser, or persistent cookies, which remain on the Data Subject's device for a defined period not to exceed twelve months.
8.4 The Data Subject may manage or disable cookies through their browser settings. The Controller notes that doing so may impair certain Site functions and that it cannot guarantee a consistent or complete experience for Data Subjects who have modified their cookie settings.
8.5 The Site does not use cookies for advertising purposes, for tracking the Data Subject across third-party websites, or for any purpose that the Controller would be unwilling to describe plainly if asked.
9.1 All inquiries, requests, rights exercises, complaints, and other correspondence relating to this Policy should be directed to the Strathmere Invitational Data Governance and Compliance Division via the contact address available on the Site's contact page. The Division reads everything. The Division responds to most things.
9.2 When submitting a request relating to Personal Data, the Data Subject is encouraged to include their full name as submitted to the Fan Picks form, the email address associated with their submission, and a clear description of the request or concern.
9.3 The Controller will acknowledge receipt of all correspondence within a reasonable period, defined operationally as no more than five business days, and will provide a substantive response within the timeframes indicated in Article VII.
9.4 The Division operates during regular business hours, which it defines with appropriate flexibility given that the organization is administered by individuals who have other professional and personal obligations. The Division does not commit to monitoring communications on weekends, public holidays, or during the tournament itself, when attention is, understandably, directed elsewhere.
9.5 If the Data Subject is not satisfied with the Controller's initial response to their inquiry, they are encouraged to indicate this and the Controller will make a further attempt to resolve the matter. The Controller notes that it takes feedback of this kind seriously and does not regard a second attempt as an inconvenience.
10.1 In interpreting the provisions of this Policy, and in particular the legitimate interests framework established under Article IV, the Controller invites the Data Subject to consider the nature of extraction itself — not merely as a technical processing activity, but as a fundamental human impulse: the drive to reach into the earth and pull out something of value, at whatever personal cost the enterprise demands.
10.2 This impulse is nowhere more completely examined than in Paul Thomas Anderson's 2007 film There Will Be Blood, and more specifically in the figure of Daniel Plainview, as rendered by Daniel Day-Lewis in a performance that functions less like acting and more like a man deciding to become someone else and declining, thereafter, to come back.
10.3 The film's opening sequence is instructive as a matter of interpretive framework. A man climbs out of a hole in the ground alone. He falls. He drags himself back to civilization on a broken leg because the ore samples in his hand are more important than the leg, and he made this determination before the leg gave out. 10.5 Day-Lewis constructs this with the specificity of a man who builds things to last. The voice — that rounded, patrician baritone assembled from John Huston and something older and stranger that belongs entirely to Day-Lewis — is not an affectation. It is infrastructure, erected because it worked, in the same way the derricks were erected because they worked. He enters rooms as though he purchased them prior to arrival. He deploys warmth with the precision of a man who learned it from a manual and has been refining the delivery ever since.
10.6 The H.W. provisions merit particular attention in this record. There exist moments, early in the proceedings, where the boy appears to reach something in Plainview that the oil has not yet reached. When H.W. is deafened in the derrick fire, the sequence that follows is the document's most devastating clause: a man who does not know how to feel something attempting, with visible effort, to feel it. The attempt fails. The boy is placed on a train. The warmth, upon review of the underlying record, was always contingent on continued utility.
10.7 Eli Sunday functions within this arrangement as the mirror the primary party cannot stand to look into. They are identical instruments deployed in different markets: one extracting oil, one extracting belief, both aware at some level of the mechanism beneath the surface. The primary party's hostility toward Sunday is unique in the record — reserved for no other counterparty — because Sunday is the only party who sees through the terms to the structure underneath. Their final transaction is not a victory. It is a final accounting. The glass is empty. The glass is on the floor. I'm finished. He is. The Controller submits that the record indicates he was always going to arrive here.
10.8 Daniel Day-Lewis received the Academy Award for Best Actor for this performance. This was the correct determination. It was also, in the considered view of the Controller, an insufficient acknowledgment of what had actually taken place.
11.1 The foregoing analysis having established that a performer may construct an entirely new interior logic and inhabit it with complete commitment — treating the constructed self not as a costume but as a load-bearing structure — the Controller notes that this standard is not exclusive to the medium of film. Professional wrestling, a discipline frequently underestimated by those who have not examined its mechanics carefully, has produced character work that meets and in certain instances approaches the threshold established in Article X above.
11.2 In the spring of 2011, Ron Killings — operating under the designation R-Truth — executed a character development that the Controller hereby enters into the record as a relevant precedent. The development was not telegraphed. One week Killings was a reliable midcard participant with a call-and-response entrance. The following week he had identified a conspiracy. He did not specify it. That was the operative feature.
11.3 The conspiracy was ambient. It existed in the booking, in the audience, in the smiling faces of the people at ringside who had always appeared to be on his side and had, he had now concluded, never actually been. He referred to this force collectively as Little Jimmy. He deployed the term with the hollow certainty of a man who has, after years of searching, finally located the source of the problem.
11.4 The distinction worth preserving in this record: Killings was not performing paranoia. He was performing the aftermath of paranoia — the strange, functional clarity on the far side of suspicion, where the enemy has a name and the name is everyone and a man can finally get some rest. The conspiracy was not going to be disproven. It could only deepen, which it did, in the manner of all well-constructed belief systems.
11.5 John Cena served as the primary counterparty. By 2011, Cena occupied a fixed institutional position — the most reliably polarizing figure in the organization, drawing equal measures of devotion and opposition from an audience that had divided cleanly along generational lines. What the framework required was a counterparty who could absorb everything Killings delivered and remain standing. Cena was that counterparty.
11.6 The proceeding designated Capitol Punishment took place on June 19, 2011, in Washington, D.C. — a jurisdiction the Controller notes is among the more conspiracy-adjacent in the continental United States, a city where the architecture implies ongoing surveillance and every monument is a dedication to a man who believed he was correct about everything. Killings arrived smoking. He was mid-conversation with parties not present.
11.7 The proceeding itself was a character study conducted in a twenty-by-twenty-foot ring. The original finding was upheld. Killings did not prevail. The conspiracy, as a result, could only grow more confirmed. This outcome was correct: the conspiracy was real in every way that mattered, and not real in the only way that would have changed the result.
11.8 This proceeding does not receive adequate recognition in the historical record. It was the finest work of Ron Killings's career and produced some of the more interesting character television the format had generated in years. Little Jimmy was not a person. As the Controller trusts is now clear, that was entirely the point.
12.1 The Controller notes, by way of supplementary context to the framework established in Articles X and XI, that the forces capable of driving a man toward irrational conduct are not limited to oil, belief systems, or ambient conspiracies. The record reflects at least one additional mechanism warranting formal analysis: a persistent, zone-based, hundred-player survival environment in which the available territory contracts on a fixed timer regardless of the participant's performance, readiness, or prior investment in the outcome.
12.2 Epic Games released Fortnite Battle Royale in September 2017. One hundred participants are deployed onto an island. Ninety-nine of them will be eliminated. The last one standing receives a Victory Royale — a designation the Controller recognizes as among the more genuinely satisfying outcomes available in the medium, achieved through a combination of skill, positioning, resource management, and the willingness to remain still in a bush for eleven minutes while other participants resolve their disputes.
12.3 The building mechanic warrants specific attention in this record. Epic's decision to allow participants to construct structures in real time — walls, ramps, full fortifications erected in seconds from harvested materials — transformed what might otherwise have been a straightforward elimination proceeding into something closer to competitive architecture conducted under live fire. The skill ceiling rose. The floor came with it. The gap between participants who had internalized the building framework and those who had not became the central organizing fact of every engagement.
12.4 The seasonal model introduced a further complication to the participant's long-term relationship with the proceeding. Every few months, the island changed. Locations were destroyed. New mechanics were introduced. Prior mastery was partially depreciated. The commitment required to remain current with these developments was, the Controller submits, not unlike the maintenance of a compliance framework: continuous, non-optional, and occasionally disorienting.
12.5 The triumphs of the format are real and documented. A Victory Royale achieved after a sustained late-game engagement — correctly managing resources, maintaining positional advantage through the final storm circle, outlasting a skilled final counterparty — produces a neurological response that the Controller declines to quantify but acknowledges is difficult to replicate through other means.
12.6 The perils, however, are equally documented and arguably more instructive. The game's design contains a specific and elegant cruelty: it will provide the participant with ninety-five percent of everything required to win, and then introduce, at the moment of greatest exposure, a counterparty who has logged twice the hours and practiced the building framework until it is no longer conscious effort but reflex.
12.7 The Controller notes that this last quality — the storm's complete indifference to the participant's state of preparation — is where the proceeding most clearly illustrates its capacity for psychological harm. A man may play well for seventeen minutes. He may make correct decisions at every juncture. He may arrive at the final circle with full shields, adequate ammunition, and a clear positional advantage. And then the storm moves, and the circle lands in an unfavorable location, and a participant he cannot see eliminates him from an elevation he did not know was occupied. He is returned to the lobby in seconds. The island offers no comment. The queue for the next match opens immediately.
12.8 It was, for several years, the dominant shared language of an entire generation. Fortnite built something that could contain everything, and it did, and the cost of that containment was borne primarily by the participants. This is, the Controller recognizes, a familiar arrangement.
13.1 The Strathmere Invitational Data Governance and Compliance Division hereby formally acknowledges that Articles X, XI, and XII of this Policy represent a material, sustained, and — the Division is compelled to admit — escalating departure from the document's stated subject matter. The Division has conducted a full internal review of the drafting record and has reached the determination that the deviations in question were neither accidental nor the result of external interference, but were introduced deliberately by the drafting personnel and permitted to continue for a combined total of approximately three thousand words across three distinct and unrelated subject areas.
13.2 The Division further acknowledges that the nature of the deviations — spanning early twentieth-century American cinema, professional wrestling, and a live-service video game released in 2017 — suggests a pattern of conduct rather than an isolated lapse, and that the drafting personnel, when asked to account for the progression from oil extraction to the Capitol Punishment pay-per-view to the Fortnite storm circle, provided an explanation that the Division found earnest but ultimately insufficient as a matter of professional governance.
13.3 The Controller wishes to clarify, as a distinct and separately operative matter, that the views expressed in Articles X, XI, and XII do not represent the official position of the Strathmere Invitational Board of Directors or any affiliated organizational body, and should not be attributed to any Board member individually or collectively. Notwithstanding this disclaimer, the Controller wishes to state, on the record and without equivocation, that nothing contained in those Articles was untrue. Every factual assertion was accurate. Every evaluative judgment was offered in good faith and is capable of sustained defense. The Controller stands behind the substance of the foregoing while acknowledging that a privacy policy was, in retrospect, a suboptimal venue for it. The Controller further wishes to state specifically, with respect to section 11.8 and the career of Ron Killings, that the spring of 2011 represented a genuine and demonstrably unrealized inflection point, and that the subsequent decision by World Wrestling Entertainment to deploy him in a predominantly comedic capacity for the better part of a decade constitutes, in the Controller's considered assessment, a fundamental misreading of an asset whose ceiling had been briefly, clearly, and publicly demonstrated. The Controller does not use the phrase "what could have been" as rhetorical ornamentation. It means it in the most literal sense available. This position is not softened by the correction notice that surrounds it.
13.4 Corrective measures have been implemented. The drafting personnel responsible for Articles X through XII have been formally addressed. A remediation plan has been developed, reviewed, and approved at the appropriate level of organizational authority. The Division has additionally commissioned an independent assessment of its internal content governance procedures, the findings of which will be incorporated into revised drafting protocols to be issued under separate cover at a date the Division declines to commit to in writing.
13.5 For the avoidance of doubt: nothing in Articles X, XI, or XII modifies, supplements, supersedes, or otherwise affects any provision of this Policy as established in Articles I through IX. Those Articles were, in the technical legal sense of the term, surplusage. They did not create obligations. They did not confer rights. They did not constitute any representation upon which the Data Subject was entitled to rely. The Controller regrets any confusion while declining to fully commit to regretting the Articles themselves.
13.6 The Controller additionally wishes to confirm that no Personal Data belonging to the Data Subject was processed during Articles X, XI, or XII. No inferences were drawn. No profiles were constructed. The Data Subject's engagement with those sections, should any have occurred, is not recorded, not retained, and not held against them in any current or future proceeding. Their continued presence in this document at this stage is noted with something the Division is prepared to characterize, with appropriate institutional caution, as genuine appreciation.
14.1 The Controller collects the Data Subject's name, email address, and prediction picks for the sole purpose of administering the Fan Picks competition and delivering occasional communications regarding the Strathmere Invitational.
14.2 The Controller does not sell, share, transfer, or otherwise disclose the Data Subject's Personal Data to any third party for any purpose, commercial or otherwise.
14.3 The Data Subject may request permanent deletion of their Personal Data at any time by contacting the Controller via the address provided in Article IX, and the Controller will action that request promptly.
